Privacy Shield Policy

Classic Color, Inc. ("Classic Color") complies with the EU-US Privacy Shield Framework as set forth by the US Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries transferred to the United States pursuant to Privacy Shield. Classic Color, Inc. has certified that it adheres to the Privacy Shield Principles with respect to such data. If there is any conflict between the policies in this privacy policy and data subject rights under the Privacy Shield Principles, the Privacy Shield Principles shall govern. Definitions
For the purposes of this Policy:

“Controller” means a person or organization which, alone or jointly with others, determines the purposes and means of the processing of Personal Data.

“Processor” means any natural or legal person, public authority, agency or other body that processes Personal Data on behalf of a Controller.

“Personal data” and “personal information” are data about an identified or identifiable individual that are within the scope of the Data Protection Directive (officially Directive 95/46/EC), received by an organization in the United States from the European Union, and recorded in any form.

“Sensitive Data” means Personal Data revealing:
  • racial or ethnic origin, political opinions, religious or philosophical beliefs
  • trade-union membership
  • genetic data, biometric data processed solely to identify a human being
  • health-related data
  • data concerning a person’s sex life or sexual orientation

Types of Personal Data Collected
As a Processor, Classic Color may receive Personal Data about individuals located in the European Economic Area (EEA) from a Controller client for the purposes of providing services to the client. The Personal Data may include name, mailing address and email address.

Services provided to the Controller include, but are not limited to, direct mailing, data analysis and marketing recommendations.

Access
Individuals in the EEA generally have the right to access their Personal Data. As a Processor of Personal Data, Classic Color does not control the Personal Data that it processes on behalf of its clients or their users and does not have a direct relationship with the users whose Personal Data may be processed in connection with providing services to a client. Since each client controls what information it collects from its users, how that information is used and disclosed, and how that information can be changed, users should contact the applicable client administrator with any inquiries about how to access or correct Personal Data. To the extent a user makes an access or correction request to Classic Color, we will refer the request to the appropriate client and will support such customer as needed in responding to any request.

Choice
When Classic Color obtains Personal Data about users with whom Classic Color does not have a direct relationship, our clients are responsible for providing the users with choices in respect to the clients’ use or disclosure of the users' Personal Data.

Under certain circumstances, Classic Color may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

Accountability for Onward Transfer
During the course of providing services, Classic Color may contract a third-party Processor. In such cases, a contractual agreement between Classic Color and the third-party Processor will be in place. Classic Color will determine that any third-party Processor adheres to the obligation of providing at least the same level of privacy protection as is required by the Privacy Shield Principles before such an agreement is made. Any Personal Data transferred to a third-party will be for limited and specified purposes.

Classic Color complies with the Privacy Shield’s Principle regarding accountability for onward transfers. Classic Color remains liable under the Principles if its agent processes such personal information in a manner inconsistent with the Principles, unless the Classic Color proves that it is not responsible for the event giving rise to the damage.

Dispute Resolution
If Classic Color maintains your Personal Data, you may direct any inquiries or complaints concerning our Privacy Shield compliance to privacy@classic-color.com. Classic Color shall respond within 45 days. If your complaint cannot be resolved through Classic Color’s internal processes, Classic Color is committed to cooperate with with the panel established by the EU data protection authorities (DPAs).

The Federal Trade Commission has jurisdiction over Classic Color’s compliance with the Privacy Shield. An individual has the possibility, under certain conditions, to invoke binding arbitration for complaints regarding Privacy Shield compliance not resolved by any of the other Privacy Shield mechanisms.
